Personal injury firms have ethical responsibilities at settlement beyond maximizing the recovery. Settlement language and planning typically affects how much of a recovery the plaintiff keeps. Often, doing so changes what they keep by more than half. This presentation will walk through a firm's ethical obligations and how to spot client risks and opportunities. In particular, we'll discuss the critical effect of settlement language, and the use of solutions (e.g., trusts, structured settlements, etc.) on what plaintiffs keep after fees, taxes, and liens).
